Terms of Service

These terms are an agreement between you and Agilient Pty Limited (ABN 37 157 911 441), the New South Wales company that operates TalkAlong. Please read them with our Privacy Policy and Clinical disclaimer. By creating an account or using the service, you agree to them.

What TalkAlong is

TalkAlong is a speech-practice tool. It is an adjunct to speech therapy — not a replacement for it, and it is not a medical device, diagnosis or treatment. Please read the Clinical disclaimer, which forms part of these terms.

Accounts and who may use it

An account is set up and managed by a responsible adult — the person practising, or a parent, guardian or authorised carer acting for them. Each account is for one person's practice. You are responsible for keeping sign-in details secure and for activity under your account, and you agree to provide accurate information.

Access, trials and billing

Access is currently offered on an invitation or trial basis, and trials are free unless we tell you otherwise. Where paid subscriptions are offered, the price, billing period and any trial terms shown to you at sign-up apply. You can cancel a subscription at any time; cancelling stops future billing, and access continues until the end of the paid period. Refunds are handled in line with the Australian Consumer Law and any refund terms shown at sign-up.

Acceptable use

Use TalkAlong only for its intended purpose — supporting speech and communication practice. Do not misuse the service, attempt to disrupt or gain unauthorised access to it, or resell or redistribute it except through a program we offer in writing.

Your content

You keep ownership of the information you put into TalkAlong. You grant us the permission we need to store and process it to provide the service, as described in the Privacy Policy. We own the TalkAlong software, brand and content.

Disclaimers and your rights under Australian law

TalkAlong is provided on a reasonable-effort basis. To the extent permitted by law, we do not guarantee particular speech or clinical outcomes — progress depends on many factors outside the app. Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or other rights that cannot lawfully be excluded. Where we are permitted to limit our liability, our total liability to you is limited to the fees you paid for the service in the period concerned.

Ending your use

You can stop using TalkAlong and close your account at any time. We may suspend or end access if these terms are breached, or if we need to for legal or safety reasons.

The law that applies

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that place. If a dispute arises, we ask that you contact us first so we can try to resolve it together, including through conciliation, before any court action.

Changes

We may update these terms as the service develops. We will change the date above and, for significant changes, let account holders know.
